OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: (a) On or about May 25, 2017 for an employee exposed to crushing hazards where swing arm locks on the Forward 9000 lift was not in place while servicing elevated vehicles at or near 910 East Main Street in Mandan, North Dakota. (b) On or about July 25, 2017 for an employee exposed to crushing hazards where wheel stops were not engaged while servicing an elevated vehicle on the Ben Pearson LMT9 lift at or near 910 East Main Street in Mandan, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and manufacturers specification which includes, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturers specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Be sure to repair damaged parts. 4. Schedule and complete all periodic and annual inspections.

29 CFR 1910.177(d)(2): The employer did not provide a restraining device or a barrier to be used when inflating tires on single piece rim wheels which are not bolted onto the vehicles: (a) On or about May 16, 2017 and at times prior for an employee exposed to struck by hazards while inflating tires used on large vehicles including trucks, tractors, and trailers at the tire service shop at or near 910 East Main Street in Mandan, ND.
