29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii): (a) Jobsite, 3792 Cedar Ridge Road, Gibsonia, PA: On or about May 16, 2017 the working platform located at the 2nd balcony level was not fully planked or decked nor were guardrails in place. The platform consisted of 4 planks and did not cover the entire open area. An employee was working on the platform and fell through the opening approximately 23 feet to the ground below. OR IN THE ALTERNATIVE: 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) Jobsite, 3792 Cedar Ridge Road, Gibsonia, PA: On or about May 16, 2017 employees working on the scaffold approximately 23 feet above the ground were not protected from falling by personal fall arrest systems or guardrail systems. The area between the walker planks and the balcony measured approximately 29 1/2 inches and did not meet the requirements of a guardrail system. An employee working on the scaffold walker planks fell and went through the unprotected opening falling approximately 23 feet to the ground below.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration; Such activities were not performed only by experienced and trained employees selected for such work by the competent person: (a) Jobsite, 3792 Cedar Ridge Road, Gibsonia, PA: On or about May 16, 2017 the Non-Stop scaffold was raised by employees who had not been trained or had the experience in moving this type of scaffold nor was a competent person directing such activities.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: (a) Jobsite, 3792 Cedar Ridge Road, Gibsonia, PA: On or about May 17, 2017 employees who performed work on a scaffold had not been trained to recognize the hazards associated with the type of scaffold being used and what procedures should be used to control or minimize such hazards. Employees had not been trained to recognize the hazards such as, but not limited to: platform construction, use, access and fall protection.
