Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating pedestrian-controlled mowers. On or about May 11, 2017, employees were exposed to amputation hazards when operating pedestrian-controlled Exmark Manufacturing Company, Viking Walk-Behind Mowers, model number VH15KA483, serial numbers 635120 and 635121 in that the mower blades continued to spin when the operator was outside the operator zone. The mowers did not have a functioning operator-present control safety system that automatically stopped the mower blades and stopped or disengaged the traction drive when the operator was outside the normal operating position. In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
