29 CFR 1910.136(a): The employer did not require employees to use protective footwear when employees' feet are exposed to foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, that remains after the employer takes other necessary protective measures. On or about May 15, 2017, and at times prior thereto, an employee had his foot caught between a pallet being lift by a forklift and the forklift mast, resulting in torn muscles and lacerations. The employee was not wearing any protection footwear.

29 CFR 1910.334(a)(2)(ii): Where there was a defect or evidence of damage that could expose an employee to injury, the defective or damaged item was not removed from service until the repairs and tests necessary to render the electric equipment safe have been made. On or about May 18, 2017, and at times prior thereto, the charging cables on the Patriot Forklift Charger were both damaged and had been repaired with clear packing tape, exposing employees to the hazard of electrical shock.
