29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about May 18, 2017- at the above addressed jobsite - employees performing masonry activities on the Third Floor Unit were working near unprotected sides/edges, thereby exposing employees to fall hazards of approximately twenty (20) feet. b) On or about May 18, 2017- at the above addressed jobsite - employees performing masonry activities on the Third Floor Unit were using an extension ladder in a stairwell that had a landing with unprotected sides/edges, thereby exposing employees to fall hazards of approximately eleven (11) to twenty (20) feet.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) On or about May 18, 2017- at the above addressed jobsite - an employee performing masonry activities on the second floor was receiving materials near unprotected wall openings, thereby exposing the employee to fall hazards of approximately fifteen (15) feet.
