Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including severe burns, to employees in that employees were exposed to a dust explosion, deflagration, or other fire hazards from combustible metal dust created from removing mill scale from carbon steel metal through the LS Industries Structural Blaster (STRB 4236) that was connected to a DCC 15 Reverse Pulse Dust Collector Bag house that was inside of the Metal Fabrication Building.  There is also a cyclone downstream of the bag house that is located outside of the building.   Ignition sources inside the building at the machine include employees smoking in the building, the process of bead blasting steel shot on carbon steel metal and machine mechanical malfunction that could generate heat and sparks.    a)        Metal Fabrication building:  On or about May 22, 2017, and prior to, employees were exposed metal dust with a Kst value of 6.06 bar meters per second and a class II dust with ignition sources in the form of lighting, electrical cords, power boxes and a dust collection motor that were not rated for Class II, Division 1 areas while conducting mill scale removal while operating the LS Industries Structural Blaster (STRB 4236).

There is also a cyclone downstream of the baghouse that is located outside of the building that has a 55 gallon collection bin drum that has never been cleaned out and was completely full with combustible metal dust.  Ignition sources inside the building at the machine include employees smoking in the building, the process of bead blasting steel shot on carbon steel metal and machine mechanical malfunction that could generate heat and sparks.    a)        Metal Fabrication building:  On or about May 22, 2017, and prior to, employees were exposed to metal dust from the 55 gallon collection bin located under the cyclone with a combustible dust with a KsT value of 6.06 bar meters per second.  The bin was completely full and the employer has no schedule times or program to check or empty the bin.

Ignition sources inside the building at the machine include employees smoking in the building, the process of bead blasting steel shot on carbon steel metal and machine mechanical malfunction that could generate heat and sparks and welding activity.    a)        Metal Fabrication building:  On or about May 22, 2017, and prior to, employees were exposed to metal dust with a combustible dust with a KsT value of 6.06 bar in the dust collection system that did not have explosion isolation protection between the dust collector and upstream process.

29 CFR 1910.145(c)(3): Safety instruction sign(s) were not used where there was a need for general instructions and suggestions relative to safety measure(s):     a)     LS Industries Blaster and dust collection system:  On or about May 22nd, 2017, and prior to, employees were exposed metal aluminum dust at the bead blaster inside of Plant 1 without required warning sign on the LS Industries Blaster to warn of safety instruction not limited to therequirement of NFPA Chapter 14 Other Metals, 14.4.1 Dust  Producing Operations, 14.4.1.6 which states the following:      Warning:  Carbon Steel Metal Only  Fire or Explosion Can Result with other Metals.
