29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about May 17, 2017, and in times prior thereto, forklift operators did not complete a training course before working in the warehouse. This condition exposed warehouse workers to the hazard of being struck by a forklift.

29 CFR 1910.178(n)(8): Under all travel conditions the truck was not operated at a speed that would permit it to be brought to a stop in a safe manner. On or about May 17, 2017, and in times prior thereto, forklift operator was traveling at too high of speed to prevent him from striking another forklift. This condition exposed warehouse workers to the hazard of being struck by a forklift.
