29 CFR 1926.100(a): Employees working in areas where there was a danger of head injury from impact, or from falling or flying objects, were not protected by protective helmets.  On or about 24 May 2017, an employee was cutting boards on the first floor of a residential home under construction without a protective hard hat on while another employee was simultaneously working on the roof directly above him conducting roofing and decking activities with a pneumatic staple gun exposing the employee on the ground floor to struck by hazards caused by objects falling from above.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye protection when exposed to eye or face hazards from flying particles:  On or about 24 May 2017, an employee was using a pneumatic staple gun to conduct roofing and decking activities on the roof of a residential home under construction up to approximately 20 feet without the use of eye protection, exposing the employee to the hazard of being struck by flying particles.  Noe Villafuerte was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1216987, citation number 1, item number 1 and was affirmed as a final order on 4/26/17, with respect to a workplace located at 901 Screech Owl Drive, Pflugerville, TX 78660.
