29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) 80 N Moore St., NY, NY: On or about 5/23/2017, establishment employees were performing exterior masonry repairs to the balconies of the entire 40 story residential structure. Employees were using hammers to chip off the old cement surface and were using BASF MasterEmaco S 440 repair mortar (Portland cement) to make repairs. The employer did not ensure that affected employees used appropriate eye or face protection when exposed to the flying cement chips or the caustic Portland cement mixture.
