29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: Mesa Ranger District: Annual audiogram testing was not made available to Law Enforcement Officers who were exposed to noise levels at or above an 8-hour time-weighted average of 85 decibels during firearms qualifications. Typical impulse sound pressure levels generated by firearms range between 150-160 dB SPLpk.

29 CFR 1910.95(j)(1): The employer did not evaluate hearing protector attenuation for the specific noise environments in which the protector will be used: Shooting Range: Law Enforcement Officers were issued David Clark, Model 10A/10AS, earmuffs (NRR: 23dB) to be used during firearms qualifications. The agency did not evaluate the attenuation afforded by the earmuffs to determine if they provided adequate hearing protection. Dual hearing protection is not required during firearms qualifications although typical impulse sound pressure levels generated by firearms range between 150-160 dB SPLpk.
