OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about May 23, 2017 through June 1, 2017 in the milking parlor, employees were exposed to fall hazards of approximately 7'11" when accessing the mezzanine to utilize the radio and store equipment.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about May 23, 2017 through June 1, 2017 in the milking parlor, employees were exposed to severe burn hazards to their eyes and face when they utilized corrosive cleaning and sanitizing chemicals such as FOAM-SHINE pH 0.5-1 at 100% concentration/pH 1.4-2.4 at dilution, BAC-FLUSH pH 1.5, and Chlorine Bleach pH 12 without wearing any appropriate eye or face protection.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    The employer did not develop, implement, and maintain a written hazard communication program when employees utilized hazardous chemicals such as FOAM-SHINE cleaning product and BAC-FLUSH Sanitizer among others in the milking parlor and chemical storage areas.     All provisions of 29 CFR 1910.1200(e) through (h) must be covered in a hazard communication program.  Key elements include, but are not limited to the following:    1.  A list of hazardous chemicals in the workplace  2.  Methods employer will use to inform employees of the hazard of non-routine tasks  3.  Methods employer will use to inform employees of hazards associated with chemicals contained in unlabeled pipes in their work area.  4.  Workplace Labeling and other forms of warning  5.  Safety data sheets  6.  Employee information and training

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  The employer did not provide employees working in the milking parlor and chemical storage areas with effective training and information on the hazardous chemicals such as FOAM-SHINE cleaning product and BAC-FLUSH Sanitizer among others.

29 CFR 1928.51(d): Operating instructions. Every employee who operates an agricultural tractor shall be informed of the operating practices contained in Appendix A of this part and of any other practices dictated by the work environment. Such information shall be provided at the time of initial assignment and at least annually thereafter.    The employer did not train employees who operate agricultural tractors in the free stall barns, maintenance area, and around the manure pits in Appendix A of this part and specific information for their job tasks including feeding, stall bedding, and manure handling.

29 CFR 1928.57(a)(6): Operating instructions. At the time of initial assignment and at least annually thereafter, the employer shall instruct every employee in the safe operation and servicing of all covered equipment with which he is or will be involved, including the safe operating practices in part 29 CFR 1928.57(a)(6)(i) through 29 CFR 1928.57(a)(6)(v):     The employer did not instruct employees in the safe operation, servicing, and maintenance of equipment being operated in the milking parlor, chemical storage areas, maintenance areas, and free stall barns and did not train employees on the following safe operating practices at initial assignment and at least annually thereafter:    1.  Keep all guards in place when the machine is in operation.  2.  Permit no riders on farm field equipment other than persons required for instruction or assistance in machine operation.  3.  Stop engine, disconnect the power source, and wait for all machine movement to stop before servicing, adjusting, cleaning, or unclogging the equipment, except where the machine must be running to be properly serviced or maintained, in which case the employer shall instruct employees as to all steps and procedures which are necessary to safely service or maintain the equipment.    4.  Make sure everyone is clear of machinery before starting the engine, engaging power, or operating the machine.  5.  Lock out electrical power before performing maintenance or service on farmstead equipment.
