29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level: (a) The employer failed to make an initial determination as to whether or not any of it's employees were over exposed to lead hazards. This was most recently demonstrated when shipments of lead ingots were made by the employer between the dates 5-7-2017 to 5-13-2017. During this process drivers were instructed that they were to manually remove wooden blocking and bracing by way of pry bar. Once complete drivers would dry sweep the container with a broom without the use of respiratory protection.

29 CFR 1910.1025(h)(2)(ii): Shoveling, sweeping or brushing methods were used to remove lead accumulations where vacuuming or other equally effective methods were available and feasible: a)The employer failed to determine if vacuuming or other equally effective means could be used prior to allowing employees to dry sweep truck container floors that contained lead dust. This was most recently demonstrated when shipments of lead ingots were made by the employer between the dates 5-7-2017 to 5-13-2017. During this process drivers were instructed that they were to manually remove wooden blocking and bracing by way of pry bar. Once complete drivers would dry sweep the container with a broom and no other methods such as vacuuming had been provided.

29 CFR 1910.1025(l)(1)(i): Employees working in an area where there is potential exposure to airborne lead at any level were not informed of the content of Appendices A and B of 29 CFR 1910.1025: a) Prior to transporting lead ingots employees of Schneider National were not trained on the hazards associated with lead nor were they provided copies of Appendices A "Substance data sheet for occupational exposure to lead" or B "Employee standard summary" of the standard. This was demonstrated when employees were allowed to transport materials from 5/7/2017 to 5/13/2017.
