29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a- 666 Greene Avenue, Brooklyn NY: On or about 05/23/17, a company worker removing cement while inside a metal container being elevated by the forks of a Lull all-terrain fork truck, was exposed to fall hazards in excess of 15 feet the ground surface below. This piece of equipment was not specifically designed by the manufacturer to support an elevated scaffold platform.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a- 666 Greene Avenue, Brooklyn NY: On or about 05/23/17, a company worker removing cement while inside a metal container being elevated by the forks of a Lull all-terrain fork truck, was exposed to fall hazards in excess of 15 feet the ground surface below. b- 666 Green Avenue, Brooklyn NY: On or about 05/23/17, company employees were working next to unprotected openings when performing masonry activities from a prefabricated, tubular, welded framed scaffold, As such these employees were exposed to fall hazards in excess of 15 feet to the ground surface below. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
