29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder: location: hoist area on or about: 5/25/16 a) Employees, loading and operating a hoist, were not provided with adequate fall protection. The employees were exposed to a fall of 11 feet. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.37(a)(3): Exit routes were not free and unobstructed. Materials or equipment were placed, either permanently or temporarily, within the exit route: location: loading dock #2 stairway on or about: 5/25/16 a) The exit route was partially obstructed. A folding ladder was placed on the stairway landing. location: 1st floor beside loading dock #1 on or about: 5/25/16 b) The exit route was partially obstructed. A table was placed in the exit route in front of the doorway. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. The Fast Linen Service Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.37(a)(3), which was contained in OSHA inspection number 760041, citation number 1, item number 1b and was affirmed as a final order on 2/5/2013, with respect to a workplace located at 3739 White Plains Road Bronx, NY 10467.
