29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:    On 06/02/2017, at 9020 Sutton Place in West Chester Township, OH, an employee working for All Point Services LLC was observed working on the exterior of a commercial structure inside a BilJax 3632T aerial lift without being attached to the boom or basket.    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    Located along various areas near the edge of a commercial roof, an employee was observed performing painting associated work activities without conventional fall protection and was exposed to unprotected side or edge fall hazards in excess of 6 feet.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:    Employer did not have a written certification to verify employees had been trained in fall protection that were observed performing painting work while not utilizing any fall protection system and exposed to a potential fall heights in excess of 6 feet.
