29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls were not utilized:    a) Scragg Area: On or about September 8, 2017, and at times prior, an employee working on the scragg was exposed to continuous noise levels at 160% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.      b) Trim Saw Area: On or about September 8, 2017, and at times prior, an employee working on the trim saw was exposed to continuous noise levels at 175% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.      c) Stackers Area: On or about September 8, 2017, and at times prior, an employee working on the stacker was exposed to continuous noise levels at 175% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Scraqg Area: On or about September 8, 2017, and at times prior, an employee working on the scragg was exposed to continuous noise levels at 160% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.    b) Trim Saw Area: On or about September 8, 2017, and at times prior, an employee working on the trim saw was exposed to continuous noise levels at 175% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.    c) Stackers Area: On or about September 8, 2017, and at times prior, an employee working on the stacker was exposed to continuous noise levels at 175% of the permissible daily noise exposure (8-hour time-weighted average sound level of 90dBA) during 480 minute sampling period.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    a) Evergreen Wood Products, Maintenance Department: On or about June 2, 2017, and at times prior, employees are exposed to chemical hazards associated with working with chemicals including, but not limited to hydraulic fluid, in the maintenance storage area and in the production area.
