29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets: On or about June 6, 2017, the workers who were at ground level and below a scaffold were observed not wearing hard hats while stone work activities were taking place above them. The workers were in the finishing stages of stonework façade activity on the front of a house under construction.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation: On or about June 6, 2017, the scaffolding in use for the stonework activity was not properly supported by base plates and mudsills on the outside back legs of the scaffold. The scaffold was three sections high that measured a total height of approximately 16 feet, with a worker present on the scaffold at a height of approximately 14 feet.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about June 6, 2017, the worker was at a height of approximately 14 feet where no fall protection of any form was in place. The worker was performing stonework façade activity on the front of a house under construction.
