29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person     (a)Rojas Construciton, LLC., at 2571 S. Westlake, Sioux Falls, SD 57106:  On and prior to June 2, 2017, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Four employees were working next to the edge of the roof on a two-story commercial property without the use of a fall protection system. The subcontractor employees were installing shingles and underlayment on the main roof of the property. This condition exposed employees to a fall hazard of approximately 24 feet to the ground below.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.      (a)Rojas Construction, LLC., at 2571 S. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  (a)Rojas Construction, LLC., at 2571 S. Westlake, Sioux Falls SD, 57106:  On and prior to June 2, 2017, the exposing employer did not ensure each employee on a walking /working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was trained in the recognition of potential fall hazards associated with working from heights, nor did they have proper training on the fall protection systems the company had on hand. This condition exposed the employees to a fall hazard of approximately 24ft.
