29 CFR 1910.1200(e)(2)(i): At a multi-employer workplace, the employer's hazard communication program as implemented did not include methods the employer used to provide other employers with on-site access to a safety data sheet for each hazardous chemical the other employers' employees may be exposed to while working:    (a) Anadarko Petroleum Corporation, at Sekich tank battery, Weld County Road 13 and Weld County Road 32, Mead, CO: On and preceding 5/25/17, the employer's hazard communication program as implemented did not include methods the employer used to provide other employers with on-site access to a safety data sheet for each hazardous chemical the other employers' employees may have been exposed to while working.  Employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc were involved in the removal of the crude oil from the three crude oil tanks, the removal of production water from the production water tank, and the construction of new piping connecting the separator to crude oil tank #1 and the production water tank.   Anadarko Petroleum Corporation, as the chemical manufacturer, developed its own Safety Data Sheets (SDS) for crude oil and produced water.  Anadarko Petroleum Corporation did not ensure that its written hazard communication program as implemented included the methods used to provide on-site access to SDS's for each hazardous chemical produced by Anadarko Petroleum Corporation that contractors' employees may be exposed to while working at Anadarko Petroleum Corporation facilities.  This condition exposed employees of Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc to a chemical hazard.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  (a) Anadarko Petroleum Corporation, at Sekich tank battery, Weld County Road 13 and Weld County Road 32, Mead, CO: On and preceding 5/25/17, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  Crude oil was extracted from wells and stored in 300 barrel steel storage tanks at the Sekich tank battery.  Employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc were involved in the removal of the crude oil from the three crude oil tanks and the construction of new piping connecting the separator to crude oil tank #1.  The crude oil tanks were labeled only with a National Fire Protection Association (NFPA) symbol, a No Trespassing sign with limited hazard information, and the identifier "crude oil".  Anadarko Petroleum Corporation listed benzene as a component of crude oil in its Safety Data Sheet (SDS) and its hazard classification included flammable, irritant, and health effects, i.e. carcinogen and mutagen.  The label elements included the pictograms for flammables, irritants, and health hazards, i.e. mutagen or carcinogen, and "may cause cancer".  The NFPA label, No Trespassing sign with limited hazard information, or identifier "crude oil" did not inform workers of the hazards identified in the SDS.  No other immediately available information at the tank battery alerted workers of the hazards identified in Anadarko Petroleum Corporation's SDS for crude oil.  This condition exposed employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc to a chemical hazard.  (b) Anadarko Petroleum Corporation, at Sekich tank battery, Weld County Road 13 and Weld County Road 32, Mead, CO: On and preceding 5/25/17, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc were involved in the removal of the production water from the tank and the construction of new piping connecting the separator to the production water tank.  The production water tank was only labeled with the identifier "produced water".  A sign outside the berm surrounding the tanks had a sign with "produced water" and a National Fire Protection Association (NFPA) symbol on it.  Anadarko Petroleum Corporation listed benzene as a component of production water in its Safety Data Sheet (SDS) and its hazard classification included carcinogen and mutagen.  The label elements included the pictogram for health hazards, i.e. mutagen or carcinogen, and "may cause cancer".  The NFPA symbol or identifier "produced water" did not inform workers of the hazards identified in the SDS. Employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, Dominguez Welding LLC, and Complete Energy Services Inc were involved in the removal of the crude oil from the three crude oil tanks, the removal of production water from the production water tank, and the construction of new piping connecting the separator to crude oil tank #1 and the production water tank. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a) Anadarko Petroleum Corporation, at Sekich tank battery, Weld County Road 13 and Weld County Road 32, Mead, CO: On and preceding 5/25/17, Anadarko Petroleum Corporation did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them).  Anadarko Petroleum Corporation directed the work of Energes Services LLC, Unlimited Services LLC, and Dominguez Welding LLC during the merging of well heads supplying two separators and two tank batteries into one separator, three crude oil tanks and one produced water tank.  Workers performed work in and adjacent to an excavation for the oil fill pipe, backpressure pipe, and bypass pipe from the separator to crude oil tank #1 and the produced water pipe from the separator to the produced water tank.  Anadarko Petroleum Corporation did not ensure that a competent person frequently and regularly inspected the worksite.  This condition exposed employees of Anadarko Petroleum Corporation, Energes Services LLC, Unlimited Services LLC, and Dominguez Welding LLC to excavation, fire, and explosion hazards.
