29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On the east side of the building being constructed the employer did not ensure that a restraint system (harness & lanyard) was utilized while utilizing an articulating boom Genie Model Z-45/25J to access the roof. Employees were exposed to the hazard of being ejected from the lift at a maximum height of approximately thirty-two (32) feet.

29 CFR 1910.178(l)(6): At this establishment, the employer had not certified that each powered industrial truck operator has been trained and evaluated as required by paragraph (l) of 1910.178, with a certification that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person performing the training and evaluation.  The employer did not ensure that the certification of training and evaluation for the operator of the Gehl Model 553 Rough Terrain forklift was maintained.
