29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Employees were exposed to harmful chemicals that could cause injuries and or illnesses in that the employer had not developed, or successfully implemented, and effective hazard communication program. This was demonstrated on June 6, 2017 at the residential construction site when an employee was using and exposed to pipe grease that was used to connect polyvinyl chloride (PVC) pipe.

This was most recently documented on or about June 6, 2017 at the jobsite located at or near 8338 Holmes Rd in Kansas City, Missouri.  An employee working in a trench with excavated materials located within two feet of the edge of the excavation exposing employees to cave-ins and struck-by hazards.

This was most recently documented on or about June 6, 2017 at the jobsite located at or near 8338 Holmes Road in Kansas City, MO.  The employer did not ensure excavations and protective systems were inspected by a competent person prior to the employees entering an excavation.  An employee was working in a trench, which had not been inspected by a competent person, which was approximately 5.6 feet in depth.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):    The employer is failing to protect employees from cave-ins and struck-by hazards associated with trenching. This was most recently documented on or about June 6, 2017 at the jobsite located at or near 8338 Holmes Rd in Kansas City, Missouri.  The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from excavation wall failure. An employee working in the trench replacing a connection which was approximately 5.6 feet in depth.
