29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    (a) Ashley Concrete Structures at 1450 Ute Ave. Aspen, CO: On or before April 18, 2017, the exposing, creating, and correcting employer did not ensure that the scaffold erected at the Stair Tower was inspected by a competent person prior to use.  The scaffold was used to perform work, even though it was missing structural components including, but not limited to, safe ladder access, connecting frame pins, cross bracing pins, and plank extensions on the working platforms.  This condition exposed employees to fall hazards of approximately 13 feet from the platform to the ground.

29 CFR 1926.501(b)(5): Each employee on the face of formwork or reinforcing steel was not protected from falling 6 feet or more to lower levels by personal fall arrest systems, safety net systems, or positioning device systems:      (a) Ashley Concrete Structures at 1450 Ute Ave. Aspen, CO: On or before April 18, 2017, the exposing, creating and correcting employer did not ensure that each employee working on the face of formwork was tied off when working more than six feet from the ground.  Employees were assembling a concrete Symons panel formwork system.  One employee disconnected his hooks to descend and retrieve more materials, and stepped onto a wooden 2 x 4 turnbuckle brace which was inadequately nailed from underneath.  This employee fell 28 feet to a concrete floor where he sustained numerous fractures including a fractured femur, vertebra, hip and wrist. This condition exposed employees to a fall hazard of 28 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):      (a) Ashley Concrete Structures at 1450 Ute Ave. Aspen, CO: On or before April 18, 2017, the exposing, creating and correcting employer did not ensure each employee was trained in fall protection by a competent person, as required under this standard, when working more than six feet from the ground.  Employees were assembling a concrete Symons panel formwork system for an elevator shaft.  One employee disconnected his hooks to descend and retrieve more materials, and stepped onto a wooden 2 x 4 turnbuckle brace which was inadequately nailed from underneath.  This employee fell 28 feet to a concrete floor where he sustained numerous fractures including a fractured femur, vertebra, hip and wrist.  This condition exposed employees to a fall hazard of 28 feet.
