29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    a)  Divider #1, on or about 5/1/17:  Neither lockout procedures in accordance with 29 CFR 1910.147(c)(4)(i) nor other effective alternative measures pursuant to 29 CFR 1910.147(a)(2)(ii) were utilized before the operator attempted to remove dough from the divider hopper.   The operator sustained a right index finger tendon laceration when the knife came down on his hand.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:  a)  Divider Area, on or about 5/1/17:  Point of operation guarding was not provided to prevent the employees from reaching inside of the Divider Machine hoppers to remove dough.  On 5/1/17 a machine operator reached into the hopper of Divider #1 and sustained a right index finger tendon laceration when the knife came down on his hand.  b)  Divider Area, on or about 5/1/17:  Point of operation guarding was not provided to prevent the employees from reaching inside of the Divider Machine hoppers to remove dough.  On 5/1/17 a machine operator reached into the hopper of Divider #2 and removed a ball of dough.  The operator did not turn the machine off and was thereby exposed to the point of operation.

Employee was exposed to in-running nip points of the belts and rollers.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:       a)  Bakewise Brands, Inc., on or about 7/25/17:   Employees have not received fire extinguisher training on an annual basis.  The last training session was provided to employees in 2014.      *ABATEMENT NOTE:  By this date the employer must either correct the alleged violation or implement a Fire Safety Policy; as outlined in 29 CFR 1910.38(a) and .39(a) which includes the evacuation requirements of 29 CFR 1910.157(b).
