29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which includes the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii), and describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) On or about May 30, 2017, at a worksite located at 1600 SE Blue Parkway, Lees Summit, Missouri ("Price Chopper"), employees were exposed to hazards associated with contact with chemicals, including, but not limited to "Formula TNT," "Triple," "Glass Cleaner," "Sanitime," and "Attack," in that the employer failed to failed to implement a written hazard communication program addressing all required elements, including, but not limited to a list of the hazardous chemicals known to be present at the worksite.

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): a) On or about May 30, 2017, at a worksite located at 1600 SE Blue Parkway, Lees Summit, Missouri ("Price Chopper"), employees were exposed to hazards associated with contact with chemicals, including, but not limited to "Formula TNT," "Triple," "Glass Cleaner," "Sanitime," and "Attack," in that the employer failed to ensure that employee training included the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv), including but not limited to the specific hazards associated with chemicals in the work area, specific measures employees can take to protect themselves from chemical hazards, and an explanation of chemical labeling and safety data sheets under the Globally Harmonized System.
