29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On 9 June 2017, three framers were working at a residence under construction in which hard hats were not being worn while there was overhead work being performed, exposing the workers to the hazard of being struck by falling tools, materials and debris.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step. On 9 June 2017, three workers were performing framing activities at a residence under construction while using the top step of a step ladder. 1) One worker used the top step of a four foot step ladder to gain access for the top plate with a pneumatic nail gun, exposing the worker to a fall hazard of approximately 4 feet to the concrete slab below. 2) Two workers accessed the top plate of the first floor by using the top step of a six foot step ladder, exposing the workers to the hazard of falling approximately 10 feet 1 inch to the concrete slab below.
