29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system: a) On or about June 9, 2017, and at times prior, employees were exposed to fall hazards in excess of 19 feet while engaged in painting operations on the roofs of a two story condominium complex with no fall protection in place. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.30(a)(1): Before employees were exposed to a fall hazard, the employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart: a) On or about June 9, 2017, and at times prior, training was not provided to employees that were exposed to fall hazards. Training of employees shall include the following: 1. Training provided by a qualified person, 2. The nature of the fall hazards in the work area and how to recognize them, 3. The procedures to be followed to minimize the hazards, 4. The correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses; and, 5. The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
