29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated  a) On or about June 9, 2017, an employee was installing windows on the third floor of an apartment, in an aerial lift basket, greater than 18 feet , where no fall protection was used.  NOTE- Abatement documentation and certification are required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about June 9, 2017, an employee was preparing the wall opening, and installing a window on the third floor of an apartment, approximately 18 feet high where no fall protection was used.  NOTE- Abatement documentation and certification are required for this item.
