29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A) On or about 06/08/2017, at the site of 78-20 79th Lane, Glendale, NY Employees were working below a scaffold where other employees were applying stucco overhead, approximately 18-feet above them. The employees below the scaffold were not provided with hard hats and exposed to being struck-by falling objects such as tools and buckets of stucco. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.451(e)(1): Portable ladder, hook-on ladder, attachable ladder, stair tower, stairway-type ladder, ramp, runway, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used to access scaffold platform more than 2 feet above or below a point of access: A) On or about 06/08/17, at the site of 78-20 79th Lane, Glendale, NY Employees performing stucco work on the exterior of the building were ascending/descending a scaffold by climbing the frame and were in danger of falling approximately 18-feet to the ground. An access ladder or equivalent safe device was not provided. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (General Industry Reference 1910.28(b)(12)(i)): A) On or about 06/08/2017, at the site of 78-20 79th Lane, Glendale, NY Employees performing stucco work on the exterior of the building from a tubular welded frame scaffold were not provided with fall protection, exposing them to a fall hazard of approximately 18-feet to the ground. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
