29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Extrusion Area; On June 13, 2017 the employer exposed employees to noise hazards, in that employees were exposed to noise levels above the Action Level of 85 dBA without the implementation of an effective hearing conservation program which would have included noise monitoring and noise training according to the noise standard.  Employees working on the Line 6 CDS Knife Cutter (Model CSFK 3.5G, Serial No 160408) while cutting pipes were exposed to continuous noise at 95.79% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 90.7 dBA during the 414 minute sampling period on June 13, 2017.  The exposure calculation included a zero increment for the 66 minutes not sampled.  Employees working on the Line 4 Upcutter while cutting pipes were exposed to continuous noise at 92.8% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 90.2 dBA during the 427 minute sampling period on June 13, 2017.  The exposure calculation included a zero increment for the 53 minutes not sampled.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) Extrusion Area; On June 13, 2017, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to implement a noise monitoring program while providing hearing protection devices to employees exposed to noise levels above the Action Level of 85 dBA while working on saws.  Employees working on the Line 6 CDS Knife Cutter (Model CSFK 3.5G, Serial No 160408) while cutting pipes were exposed to continuous noise at 95.79% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 90.7 dBA during the 414 minute sampling period on June 13, 2017.  The exposure calculation included a zero increment for the 66 minutes not sampled. The employer did not institute a training program and ensure employee participation in the program:  a) Extrusion Area; On June 13, 2017, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to provide training to employees exposed to noise above the Action Level of 85 dBA while cutting plastic pipes.  Employees working on the Line 6 CDS Knife Cutter (Model CSFK 3.5G, Serial No 160408) while cutting pipes were exposed to continuous noise at 95.79% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 90.7 dBA during the 414 minute sampling period on June 13, 2017.
