29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: Worksite: When employees were conducting trenching and excavation activities on contaminated soil, the employer did not require exposed workers to wear personal protective equipment to protect against contact with the soil. Environmental analysis of the soil revealed excessive levels of Arsenic.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances: Worksite: When employees were conducting excavation of Arsenic-contaminated soil, the employer did not provide adequate washing facilities for employees to properly wash and remove contaminated material from hands, face, and person.
