29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) WYNNEWOOD ROAD, CAMP HILL PA - The employer had not sufficiently trained employees performing sewer line installation and trenching work on the specific safety requirements for trenching and excavation activities, which thereby exposed employee(s) to possible injuries when they continued to perform work in and near an unprotected 8.5 foot deep trench that was visibly compromised and in the process of caving in, on or about June 13, 2017. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) WYNNEWOOD ROAD, CAMP HILL PA - Employees were installing 24 inch diameter sewer line in an approximately 32 inch wide trench at a depth of approximately 8.5 feet, where the North face of the trench was cracked and failing, and their was no means of protection being used to protect the employee(s) from the cave-in hazard, on or about June 13, 2017. No abatement certification or documentation required.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) WYNNEWOOD ROAD, CAMP HILL PA - Employees were installing 24 inch diameter sewer line in an approximately 32 inch wide trench at a depth of approximately 8.5 feet, where the North face of the trench was cracked and failing. There was no means of protection being used, and the foreman continued to try and install the sewer pipe in the trench while standing on the top of the pipe, with other employees working at the edge of the surface of the trench, on or about June 13, 2017. No abatement certification or documentation required.
