29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about June 14, 2017, and at times prior, employees were exposed to cave-in hazards while working in an unprotected trench that ranged in depth from 5 feet to 6.6 feet. The spoil pile stood on the edge of the trench in several spans increasing the height of the trench in those locations. During the inspection the soil was evaluated to be type C. The sides were sloped from 55 degrees to 69 degrees. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) On or about June 14, 2017, and at times prior, employees were exposed to cave-in hazards while working in an unprotected trench that had not been evaluated for hazards by the competent person on site. The trench ranged in depth from 5 feet to 6.6 feet, requiring a protective system. The spoil pile stood on the edge of the trench in several spans increasing the height of the trench in those locations. During the inspection the soil was evaluated to be type C . The sides were sloped from 55 degrees to 69 degrees. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about June 14, 2017, and at times prior, employees were exposed to cave-in hazards while accessing and exiting a trench that did not have a ramp or ladder. The trench ranged in depth from 5 feet to 6.6 feet. Spoil piles stood on the edge of the trench in several spans increasing the height of the trench in those locations. The northeast length of the staggered trench was 28 feet long, and the southwest length was 32 feet long. The sides were sloped from 55 degrees to 69 degrees. Employees scrambled up and down the sides of the trench wherever they could. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
