29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Drive-through Window Side of the Restaurant - Two employees, one at the front corner and one at the back corner on the drive-through window side of the building, stood on the flat roof removing the mansard. These employees did not use fall protection. They wore harnesses but did not tie off, exposing the employees to the hazard of falling nine feet to the ground below, on or about June 16, 2017. No abatement certification or documentation required; corrected during the inspection.
