29 CFR 1926.1417(o)(1): The equipment was operated in excess of its rated capacity. Construction site: On or about June 13, 2017 a 165 Ton Crane was operated in excess of its rated capacity and tipped over. This condition exposed employees to a struck-by hazard. Hector Berumen was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1417(o)(1), which was contained in OSHA inspection number 1240864, citation number 1, item number 2 and was affirmed as a final order on July 13, 2016 with respect to a workplace located at 122 S Old Pueblo Rd, El Paso, Texas, 79907.
