29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) On or about June 16, 2017, two (2) employees installing siding on a ladder-jack scaffold were not protected from falling 13 feet to the ground by the use of a guardrail system or personal fall arrest system.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)  a) On or about June 16, 2017, outside the building under construction, two employees were cutting "Hardie Plank", a silica-containing siding, with a handheld De Walt circular saw and the employer failed to develop and implement a written hazard communication program.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)   a) On or about June 16, 2017, outside the building under construction, employees were required to wear a tight-fit half mask or a N-95 disposable respirator while cutting "Hardie Plank" siding boards and the employer failed to establish and implement a written respiratory protection program.
