29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  200 Ligon St., Norfolk, VA 23523, U.S.S. Gonzalez: On or about June 28, 2017, and times prior thereto, employees were exposed to noise levels in excess of the allowable 8-hour time weighted average (TWA) of 85dBA. This violation was observed on or about June 28, 2017,  a) Where noise sampling performed up to 264 minutes indicated that an employee was exposed up to an approximately 379.1 percent noise dose which is equivalent to 99.6 dBA, exposing the employee to potential hearing loss. Zero exposure was assumed for the 216 minutes not sampled.  b) Where noise sampling performed up to 262 minutes indicated that two employees were exposed up to an approximately 149.7 percent noise dose which is equivalent to 92.9 dBA, exposing employees to potential hearing loss. Zero exposure was assumed for the 218 minutes not sampled.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) 200 Ligon St., Norfolk, VA 23523, U.S.S. Gonzalez: On or about June 28, 2017, and times prior thereto, the employer did not provide a medical evaluation for a temporary employee that was required to wear a respirator for operations that included removing flooring with a DeWalt chipping hammer, exposing the employee to respiratory hazards.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Gonzalez: On or about June 28, 2017, and times prior thereto, the employer did not provide a fit test at least annually for an employee that was required to wear a respirator for operations that included removing flooring with a DeWalt jackhammer, exposing the employee to respiratory hazards.  b) 200 Ligon St., Norfolk, VA 23523, U.S.S.
