29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   a) Shop Area - On or about June 21, 2017, the employer did not develop or implement a written hazard communication program, in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employee(s) were exposed to hazardous chemicals, including Super 16 Paint Gun Cleaner (s-0170B) (contains toluene, 2-propanone, 2-butanone, 2-butoxyethanol, 2-methyl-4-pentanone, acetic acid, butyl ester, ethyl benzene, methanol, and xylene), and Crystal Clean 142 Mineral Spirits (contains distillates (petroleum), aliphatic).

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical(s) contained therein:     a) Screen Printing - On or about June 21, 2017, the employer did not ensure that each container of hazardous chemicals in the workplace, including a spray bottle of Super 16 Paint Gun Cleaner (s-0170B), was labeled with the identity of the chemical and the information regarding physical and health hazards of the hazardous chemicals contained therein.

29 CFR 1910.1200(h)(1): Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:     a) Shop Area - On or about June 21, 2017, the employer did not provide information and training to employees exposed to hazardous chemicals, including Super 16 Paint Gun Cleaner (s-0170B) (contains toluene, 2-propanone, 2-butanone, 2-butoxyethanol, 2-methyl-4-pentanone, acetic acid, butyl ester, ethyl benzene, methanol, and xylene), and Crystal Clean 142 Mineral Spirits (contains distillates (petroleum), aliphatic).   b) Shop Area - On or about June 21, 2017, the employer did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements, as required by the revised 2012 hazard communication standard, 29 CFR 1910.1200.
