29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.) While performing trenching operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employee/s were exposed to engulfment, fall hazards in excess of six (6) feet and struck-by hazards do to a lack of foot protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): Employees performing water pipe installation in an excavation in excess of seven (7) feet in depth were not working within a protective system. Employees were exposed to a cave-in hazard. The excavation varied in length and was approximately thirty (30) inches in width. Dutton Construction and Plumbing LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1084698, citation number 1, item number 5 and was affirmed as a final order on 22 December 2015, with respect to a workplace located at 801 E. Douglas Ave, Wichita, Kansas.
