29 CFR  1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  At the Trenching and Excavation site located in the 300 block of E. Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to cave in hazards in that the competent person allowed employee(s) to enter the trench where standing water was present, without the proper slope configurations and/or the proper benching systems, while a cross trench was dug allowing water to flow through the active trench employee(s) were standing in.

Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to escape hazards in that the employer did not have a written permit space program but required employee(s) to get in a manhole to clear a storm water drain for installation operations and to drain the water from an active trench so trenching operations could proceed.

Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to struck by and falling objects in that employee(s) were not wearing hard hats while working inside a trench and in close proximity to excavation equipment while working on a the benched portion of a trench.  Dutton Construction & Plumbing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 1437859, citation number 1, item number 1, and was affirmed as a final order on 12-10-21, with respect to a workplace located at 8110 -8112 E. 34th Ct. Wichita, KS 67210.

Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to cave in hazards in that employees were found to be inside a trench 5 feet or more in depth where a ladder or other means of egress was not present inside the trench.  Dutton Construction & Plumbing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 1437859, citation number 2, item number 2, and was affirmed as a final order on 12-10-21, with respect to a workplace located at 8110 -8112 E. 34th Ct. Ford St, in Valley Center, Sedgwick County, KS, employee(s) engaged in trenching and excavation activities were exposed to cave in hazards in that employee(s) were inside a trench approximately 8 feet in depth without the use of an adequate protective system. The trench was benched, but not in accordance with the proper ratio of 3/4:1 for Type B soil.  Dutton Construction & Plumbing, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1241502, citation number 2, item number 1, and was affirmed as a final order on  December 26, 2018, with respect to a workplace located on the south side of the road on Rock Road, in Derby, KS.
