29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: The employer is failing to protect employees from struck-by hazards. This was most recently documented October 15, 2019 at a jobsite located between 8110-8112 East 34th Court Wichita, Kansas. Employees engaged in water meter connection activities inside the North and South trenches were exposed to struck-by hazards in that head protection was not used. a) The employees working in the North trench were not equipped with head protection. The trench was found to be greater than 4 feet in depth with the spoil pile at the edge of the trench. The spoil pile at the North trench was found to be between approximately 1 and 5 inches from the edge of the trench. b) The employees working in the South trench were not equipped with head protection. The trench was found to be approximately 5 feet in depth with the spoil pile at the edge of the trench. The spoil pile at the South trench was found to be between approximately 1 and 5 inches from the edge of the trench.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: The employer is failing to protect employees from cave-in and struck-by hazards. This was most recently documented as a jobsite located at 8110-8112 E. 34th Court, Wichita, Kansas. An employee engaged in water meter installation activities inside of the North trench was exposed to cave-in and struck-by hazards in that the employer had not trained the employee to recognize and avoid unsafe conditions associated with trenching and excavations and the regulations applicable to the work environment. Unsafe conditions observed at the North trench include: a) The trench was found to be greater than 4 foot in depth and was not equipped with a ladder, ramp, or other means of safe egress. b) The spoil pile was found to be between approximately 1 and 5 inches from the edge of the trench. Dutton Construction and Plumbing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1084698, citation number 1, item number 1 and was affirmed as a final order on 12/22/2015, with respect to a workplace located at 801 E. This was most recently documented October 15, 2019 at a jobsite located between 8110-8112 East 34th Court Wichita, Kansas. Employees engaged in water meter connection activities, inside of trenches found to be greater than 4 feet in depth, were exposed to trip, fall, and cave-in hazards in that a safe means of egress was not located inside the trench. a) The North trench was found to be greater than 4 feet in depth and was not equipped with a ladder, ramp or other means of safe egress. b) The South trench was found to be approximately 5 feet in depth and was not equipped with a ladder, ramp or other means of safe egress.
