OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing injuries from the failure to utilize the rollover protection structure (ROPS) while operating riding lawn equipment and not ensuring that employees refrained from operating the lawn equipment on inclines greater than 15 degrees: a) Jobsite at Target Distribution Center - 3001 Archer Drive in Chambersburg, PA, West Drainage Basin. On June 14, 2017, an employee was exposed to crushing hazards while operating the Hustler branded zero-turn riding lawnmower without the rollover protective structure (ROPS) in the raised position and while operating the mower on a hillside at an angle of approximately 31 degrees. While using the mower in this condition, the mower rolled approximately 20 feet down a 31 degree hillside where the employee sustained severe injuries and was transported by helicopter and admitted to the hospital. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
