29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. On or about 19 June 2017 and at times prior thereto, an employee without eye protection was operating a pneumatic nail gun while performing framing activities on the second floor of a multi-family residence under construction, exposing the employee to the hazard of being struck in the eyes by flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about 19 June 2017 and at times prior thereto, 3 employees without fall protection were performing framing activities on the second floor of a multi-family residence under construction, exposing the employees to the hazard of falling approximately 10 feet to the ground below.
