29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: The employer is failing to protect employees from cave-in hazards. This was most recently documented at a worksite located at or near 3621 LeMesa Way, South Sioux City, Nebraska 68776 on or about June 21, 2017. The employer is failing to ensure that spoil piles remained at least two (2) feet away from the edge of the trench/excavation while utility work was being performed. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): The employer is failing to protect employees from cave-in hazards. This was most recently documented at a worksite located at or near 3621 LeMesa Way, South Sioux City, Nebraska 68776 on or about June 21, 2017. The employer is failing to ensure that employees were adequately protected from cave-ins while in the process of doing utility work when employees were in the trench. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed.
