This condition exposed employees to the lack of information regarding chemicals used in the workplace.    Abatement note:  29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift:  (a) Duckels Construction, Inc., 2301 12th and Yampa, Steamboat Springs, CO 80487:  On and before 06/26/2017, the exposing employer did not ensure that a competent person conducted inspections of the worksite to identify and correct hazardous conditions capable of causing injury.  Employees on location were working in a trench measuring 4.8 feet deep.  No daily inspection of the worksite by a competent person was performed.  This condition exposed employees to potential safety hazards when working in and around excavations.
