29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work areas:  (a) Duckels Construction Inc. at 12th and Yampa, Steamboat Springs, CO, 80487:  On and before June 26, 2017, the employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, such as, but not limited to, BASF DELVO Stabilizer, and BASF POZZOLITH NC 534 (aka Conset NC).  This condition exposed employees to the lack of information regarding chemicals used in the workplace.    Abatement note:  29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift:  (a) Duckels Construction, Inc., 2301 12th and Yampa, Steamboat Springs, CO 80487:  On and before 06/26/2017, the exposing employer did not ensure that a competent person conducted inspections of the worksite to identify and correct hazardous conditions capable of causing injury.  Employees on location were working in a trench measuring 4.8 feet deep.  No daily inspection of the worksite by a competent person was performed.  This condition exposed employees to potential safety hazards when working in and around excavations.
