29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) For the trench excavated approximately 23 linear feet on this commercial site, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift. Employees were working to install a sewer line in an excavation at a depth of approximately 10 feet. Inspections were not completed to ensure employees had proper ingress/egress and/or the trench shield was installed properly to restrict potential lateral movement in the event of the application of sudden lateral loads and did not have the required tabulated data available upon request. Abatement certification IS required for this item.
