29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift or after rainstorms or other hazard increasing occurrence: a) Job site, 340 Cherry Street, Latrobe, PA: On or about June 22, 2017, during excavation activities, the employer did not have a competent person perform an appropriate inspection of an excavation and the work activities inside of it in that an employee was permitted to operate a bob cat machine inside an excavation determined to be at least 5 1/2 feet to 7 feet in depth where appropriate cave in protection was not in use.
