29 CFR 1910.178(l)(4)(i):  Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely:    Refresher training had not been conducted for work at the Harviell, MO construction site, as indicated by operation of a powered industrial truck in order to elevate an employee to do work without fall protection (see 1910.178(l)(4)(ii)(A)).  There was no three year re-evaluation (See 1910.178(l)(4)(iii)).    Abatement documentation is required for this violation.

29 CFR 1926.454(a)(3): The employer did not train each employee who performs work on a scaffold, by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, including the proper use of the scaffold and the proper handling of materials on the scaffold:  At the Harviell, MO construction site, employees who were working off of a scaffold (which would include an extensible boom platform) or who had worked off of a scaffold, such as a walk board, were not trained on what was the proper type of work platform when exposed to a fall hazard.  Abatement documentation is required for this violation.
