29 CFR 1910.134(c)(2)(i): The employer did not determine if the voluntary use of a respirator did not in itself create a hazard: For the employee welding on mild steel and stainless steel in the welding bay on or about June 29, 2017 and times prior there to, the employer did not assess the conditions to assure the voluntary use of a respirator would not create a greater hazard to the employee and supply the information contained in Appendix D of this standard. This exposes the employee to the hazard of airborne exposures and aggravating preexisting respiratory illnesses.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: For the employee wearing the half face air purifying respirator while welding on or about June 29, 2017 and times prior there to, the employer did not provide the employee a medical evaluation, fit test, direction on proper storage, how to determine when to change the filter cartridges, or inspect the respirator for damaged or worn parts.
