29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations: (a) On or about June 28th, 2017 and at times prior employees were exposed to a struck-by hazard from overhead soil while repairing a water and sewer line in a trench approximately seven feet deep where the spoil pile was placed directly on the edge of the trench in the vicinity of Main Street NW & Renseller Avenue in Tappen, North Dakota. (b) On or about June 28th, 2017 and at times prior employees were exposed to a struck-by hazard from overhead soil while repairing a water and sewer line in a trench approximately seven feet deep where the spoil pile was placed directly on the edge of the trench in the vicinity of First Street NW & Renseller Avenue in Tappen, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 982121, Citation 1, Item 1B, and was affirmed as a final order on 12/23/2014, with respect to a workplace located in the vicinity of Fifth Street NE and Mitchell Avenue in Steele, North Dakota.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about June 28th, 2017 and at times prior employees were exposed to cave-in hazards while installing a water line in a trench approximately seven feet deep with exposed ends in the trench box in the vicinity of Second Street NE & Van Buren Avenue in Tappen, North Dakota. (b) On or about June 28th, 2017 and at times prior employees were exposed to cave in hazards while repairing a water and sewer line in an unprotected trench approximately seven feet deep near vertical walls in the vicinity of Main Street NW & Renseller Avenue in Tappen, North Dakota. (c) On or about June 28th, 2017 and at times prior employees were exposed to cave in hazards while repairing a water and sewer line in an unprotected trench approximately seven feet deep near vertical walls in the in the vicinity of First Street NW & Renseller Avenue in Tappen, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 982121, Citation 1, Item 1C, and was affirmed as a final order on 12/23/2014, with respect to a workplace located in the vicinity of Fifth Street NE and Mitchell Avenue in Steele, North Dakota.
