29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems.                                                                                                             The employer is failing to protect employees from fall hazards associated with performing residential construction activity while exposed to falls 6 feet or greater.  The most recent occurrence of this was observed on June 30, 2017 at the new home being built at SW Corner of 218th Ave & Miranda St. Elkhorn, NE where the employer has a crew of 7 employees framing a new home and employees work sitting on the top plate of an exterior wall exposed to a fall hazard of approximately 12 feet 8 inches.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   The employer is failing to protect employees from fall hazards associated with the improper use of ladders while performing residential construction activity.  The most recent occurrence of this was observed on June 30, 2017 at the new home being built at SW Corner of 218th Ave & Miranda St. Elkhorn, NE where the employer has a crew of 7 employees framing a new home and using the top half of a 25 foot Werner fiberglass extension ladder that did not extend at least 3 feet over the upper landing surface.

29 CFR 1926.1053(b)(4):  Ladder(s) were used for purposes other than the purpose for which they were designed:   The employer is failing to protect employees from fall hazards associated with the improper use of ladders while performing residential construction activity.  The most recent occurrence of this was observed on June 30, 2017 at the new home being built at SW Corner of 218th Ave & Miranda St. Elkhorn, NE where the employer has a crew of 7 employees framing a new home and using fiberglass ladders as means of access to work; improper use of ladders include but are not limited to:   i.   An employee working off of an 8 foot Werner fiberglass ladder by leaning it against the wall.    ii.  Employees using the top half of a 25 foot Werner fiberglass extension ladder as means of access to the top plate on the interior/exterior walls.
